Terms & Conditions of Driver Training

1. Licence and fitness to drive

You must hold a current and valid driving licence appropriate for the tuition you are receiving. You must tell Joe immediately about any change to your licence, medical fitness or legal entitlement to drive. You must meet the required eyesight standard and use glasses or contact lenses where required.

2. Lesson payments

Lessons and prepaid tuition are paid in advance as agreed at the time of booking. Where advance payments are made, records of the amount paid and lessons used will be maintained. Refunds for unused lessons will be provided where required by law. Lessons already taken are non-refundable unless required by law.

3. Cancellations and rearrangements

A minimum of 48 hours' notice is requested for cancelling or rearranging a lesson. Where less notice is given, a late cancellation may be charged at the full lesson rate where the appointment cannot reasonably be re-filled. Where appropriate, Joe may offer a rearranged appointment instead. Missed lessons and no-shows may be charged in full.

4. Communication

Please keep Joe informed of your current contact details and communicate changes to appointments as soon as possible. WhatsApp, text, telephone and email may be used for lesson and business communications.

5. Weather, traffic and vehicle problems

Lessons may need to be rearranged where weather or road conditions make tuition unsafe. Joe will make the decision based on the conditions, the pupil's ability and relevant safety advice. If a lesson is interrupted by a mechanical problem or other circumstance outside reasonable control, any unused tuition time will be rearranged where practical.

6. Punctuality

Please arrive ready for your lesson at the agreed time. If you are late, the lesson will normally finish at the scheduled time and the lost time may not be recoverable. If Joe is delayed, he will make reasonable efforts to provide the full tuition time or make up lost time.

7. Holidays and availability

Joe will give reasonable notice of planned holidays or periods of unavailability where possible. Pupils are asked to provide similar notice of holidays or breaks so that regular tuition can be maintained.

8. Fitness and conduct during lessons

You must attend lessons fit to drive and must not be impaired by alcohol, drugs, medication, illness, fatigue or any other condition that could make driving unsafe. If Joe reasonably believes that you are unfit to drive or that continuing the lesson would be unsafe, the lesson may be stopped or cancelled and the full lesson fee may remain payable.

9. Driving tests

Regular lessons and appropriate preparation are strongly recommended before a practical driving test. Joe reserves the right to withhold use of the tuition vehicle for a practical test if he reasonably believes the pupil is not at a safe or appropriate standard, or if there is an issue concerning the vehicle, insurance or availability. This is a safety decision and does not guarantee or prevent a test result.

10. Vehicle damage and legal responsibility

Every reasonable effort will be made to avoid damage to the tuition vehicle. If damage occurs as a result of unsafe or negligent driving, the circumstances may be discussed with the pupil and a contribution towards repair costs may be sought where appropriate, subject to the terms of the relevant insurance policy. Any fines, penalties or legal infringements arising from the pupil's driving are the pupil's responsibility.

11. Professional conduct

Lessons are provided on a professional, respectful and one-to-one basis. Both pupil and instructor are expected to behave respectfully and maintain appropriate professional boundaries throughout tuition.

12. Complaints

If you have a concern about your tuition, please raise it with Joe as soon as possible so that an opportunity is provided to resolve the matter directly. Complaints will be considered fairly and in accordance with applicable consumer rights.

13. Statutory rights

Nothing in these terms is intended to exclude or restrict any statutory rights you may have as a consumer.

14. Agreement

By booking or taking driving lessons with Drive With Joe, you acknowledge that you have had the opportunity to read these terms and agree to them as applicable to the tuition provided.
